Terms of Service

These Terms of Service (“Terms”) govern your access to and use of https://top10bars.com.au (the “Site”), operated by Digifix Pty Ltd ABN (“we”, “us”, or “our”). By accessing or using the Site you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 18 years of age to create an account or submit content to the Site. By using the Site you represent that you are 18 or older and have the legal capacity to enter into a binding agreement.

2. Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and complete information when registering.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Listing Submissions

3.1 Free submissions

You may submit a bar listing at no cost. Submitting a listing does not guarantee:

• Approval or publication.
• Inclusion in any Top 10 editorial page.
• Any particular ranking or placement on the Site.

All submissions are subject to editorial review. We may reject, request changes to, or remove any submission at our sole discretion.

3.2 Featured listings

Businesses may pay to upgrade an approved listing to Featured status. Featured placement:

• Gives the listing enhanced visibility in designated featured sections of the Site.
• Does not guarantee inclusion in, or a specific position on, any manually curated Top 10 editorial page. Editorial rankings remain independent of commercial relationships.
• Is subject to the payment terms in Section 7.
• May be removed if the listing is found to violate our content standards or these Terms.

3.3 Listing claims

If you believe you are the owner of a listed business you may submit a claim. Approval of a claim requires verification at our discretion and does not modify the editorial status of the listing.

4. Guest Post Submissions

• Guest post submissions require payment of the applicable fee.
• Payment does not guarantee publication. All content is subject to editorial review for quality, accuracy, and relevance.
• We may reject, request revisions to, or remove any guest post at our sole discretion.
• Published guest posts and sponsored content will be clearly labelled as such.
• Refund eligibility for rejected guest posts is governed by Section 7.4.

5. Content Standards

You must not submit content that:

• Is false, misleading, or likely to deceive consumers (including fake reviews or fabricated business details).
• Infringes any intellectual property right, including copyright and trade marks.
• Is defamatory, harassing, threatening, obscene, or unlawful.
• Contains spam, unsolicited commercial messages, or malware.
• Violates any applicable Australian law, including the Australian Consumer Law and Spam Act 2003 (Cth).

We reserve the right to remove content that violates these standards without notice and without refund.

6. Intellectual Property

6.1 Our content

All editorial content, design, graphics, and code on the Site are the property of Digifix Pty Ltd or our licensors. You must not reproduce, distribute, or create derivative works without our express written permission.

6.2 Your content

By submitting content to the Site (including listing details, images, and guest post articles) you grant Digifix Pty Ltd a perpetual, worldwide, royalty-free, non-exclusive licence to use, reproduce, modify, publish, and display that content on the Site and in related marketing materials. You retain ownership of your content and warrant that you hold all necessary rights to grant this licence.

7. Payments and Refunds

7.1 Fees

Fees for featured listings and guest post submissions are displayed at the time of purchase and are in Australian dollars (AUD) inclusive of GST where applicable.

7.2 Payment processing

Payments are processed by Stripe. By completing a payment you agree to Stripe's terms.

7.3 Featured listing refunds

Featured listing fees are non-refundable once the featured period has commenced. If we are unable to provide the featured placement due to our error, we will offer a pro-rata credit or refund.

7.4 Guest post refunds

If a guest post submission is rejected by our editorial team, we will refund 100% of the submission fee. No refund is available once a guest post has been published.

8. Editorial Independence

Top 10 editorial pages are manually curated by our editorial team. Rankings and inclusions are based solely on editorial merit. Commercial relationships (featured listings, guest posts, or advertising) do not influence editorial rankings. We do not sell positions on Top 10 pages.

9. Disclaimer of Warranties

The Site is provided on an “as is” and “as available” basis without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free from viruses or other harmful components. Business information listed on the Site (hours, contact details, etc.) is provided by third parties and may be inaccurate or out of date. Always verify information directly with the venue.

10. Limitation of Liability

To the maximum extent permitted by Australian law, Digifix Pty Ltd and its directors, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use, the Site. Our total liability to you for any claim arising out of these Terms will not exceed the amount you paid to us in the 12 months preceding the claim.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee under the Australian Consumer Law that cannot be lawfully excluded.

11. Third-Party Links

The Site contains links to third-party websites (including bar venues). We do not endorse or control those sites and are not responsible for their content, services, or privacy practices.

12. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, if you breach these Terms. You may close your account at any time by contacting us. Termination does not affect any rights or obligations that accrued before the termination date.

13. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms with an updated effective date. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms. Material changes will be notified to registered users by email.

14. Governing Law

These Terms are governed by the laws of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria for any dispute arising under these Terms.
